  1. Scope

These Terms of Service apply to the use of afbynx.shop and to purchases made through our online store.

We sell to customers in European countries made available during checkout.

Mandatory consumer protection rights under the law applicable to the customer are not excluded or restricted by these Terms.

If applicable local law provides stronger consumer protection, that mandatory law will prevail.

  1. Products

We make reasonable efforts to ensure that product descriptions, photographs, specifications, prices and availability are accurate.

Product images may appear slightly different depending on screen settings, lighting or product production variations.

Minor differences that do not affect the advertised nature or functionality of the product do not necessarily constitute a defect.

Nothing in this section limits statutory rights concerning goods that do not conform to the contract.

  1. Product Availability

Products are subject to availability.

If an ordered product becomes unavailable after an order is placed, we may cancel the affected item and refund any amount paid for it.

  1. Prices and Taxes

The applicable product price is displayed before checkout.

Applicable taxes, delivery charges and other mandatory costs are displayed before the customer confirms the order where required by law.

Prices may change at any time before an order is placed.

A price change does not affect an order that has already been accepted unless required by law or agreed with the customer.

  1. Orders

Submitting an order constitutes an offer to purchase the selected products.

After an order is submitted, an electronic confirmation is normally sent to the email address provided by the customer.

The sales contract is formed when the order is accepted in accordance with the checkout and order confirmation process.

We may refuse or cancel an order where permitted by law, including in cases involving product unavailability, payment failure, suspected fraud or an obvious pricing error.

If payment has already been collected for a cancelled order, the relevant amount will be refunded.

  1. Payment

Available payment methods are displayed during checkout.

By selecting a payment method, the customer confirms that they are authorised to use it.

Payment services may be provided by independent payment processors.

If payment cannot be authorised, the order may not be accepted or dispatched.

Refunds are normally issued using the original payment method unless otherwise agreed or required by law.

  1. Shipping and Delivery

Shipping is governed by our Shipping Policy.

Available delivery destinations, shipping methods, estimated delivery times and applicable costs are displayed through the store or during checkout.

Where mandatory consumer law places responsibility for goods on the seller until delivery to the customer, that responsibility remains with us until the legally relevant point of delivery.

  1. Right of Withdrawal and Returns

Customers who have a statutory right of withdrawal may exercise that right in accordance with applicable law.

For customers covered by European Union consumer withdrawal rules, eligible online purchases generally include a 14 day withdrawal period.

Our Refund and Return Policy explains the procedure, applicable return costs and refund process.

Nothing in our Refund and Return Policy restricts mandatory statutory rights.

  1. Online Withdrawal Function

Where required by European Union or applicable national law, customers who concluded an eligible distance contract through our online interface will also be able to exercise their withdrawal right using an easily accessible online withdrawal function during the applicable withdrawal period.

Use of the online withdrawal function does not prevent the customer from using other legally permitted methods of withdrawal.

  1. Defective or Non Conforming Goods

Customers are entitled to remedies required by applicable consumer law if goods are defective or do not conform to the contract.

Depending on applicable law and the circumstances, remedies may include repair, replacement, price reduction, termination of the contract or refund.

For consumers protected by European Union law, goods generally benefit from a minimum two year legal guarantee.

Some countries provide additional or longer protection.

  1. Commercial Warranties

Any commercial warranty offered by us or by a manufacturer is additional to statutory consumer rights.

A commercial warranty does not replace or reduce a legal guarantee.

  1. Product Use and Safety

Customers should use products in accordance with the instructions, warnings and intended purpose supplied with the product.

Nothing in this section reduces statutory rights concerning defective or unsafe goods.

  1. Website Use

The website may not be used:

For unlawful purposes

To commit fraud

To interfere with the operation or security of the website

To introduce malicious software

To attempt unauthorised access to systems or data

To infringe intellectual property rights

To misuse another person's information

We may take reasonable measures to protect the website and other users from misuse.

  1. Intellectual Property

Original website content, branding, text, graphics, photographs, design elements, logos and other protected materials may be subject to intellectual property rights.

Nothing in these Terms transfers ownership of those rights to website users.

  1. Third Party Services

Our website may use third party services for payments, delivery, technology, analytics or other functions.

Independent third parties may have their own terms and privacy policies.

  1. Privacy

Personal data is processed in accordance with our Privacy Policy and applicable data protection law.

  1. Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Mandatory consumer rights remain unaffected.

To the extent permitted by law, we are not responsible for losses caused exclusively by circumstances outside our reasonable control.

  1. Events Outside Our Reasonable Control

Delivery or performance may occasionally be delayed by circumstances outside our reasonable control, including carrier disruption, severe weather, natural disasters, infrastructure failure, customs delays, government action or other exceptional events.

Mandatory rights relating to delayed or failed delivery remain unaffected.

  1. Changes to These Terms

We may update these Terms from time to time.

The version applicable when an order is placed will normally govern that order unless applicable law requires otherwise.

  1. Governing Law

To the extent permitted by law, these Terms and contracts with CAMARO SS ApS are governed by the laws of Denmark.

This choice of law does not deprive a consumer of mandatory protections provided by the law that would otherwise apply in the consumer's country of habitual residence.
